(b) Neither the County nor any department, board, commission, officer, employee, or agent <br /> shall be held liable or responsible for any damage or injury caused by or resulting from <br /> the issuance of any permit, or any inspection or approval or issuance of a certificate of <br /> inspection, made under the provisions of the construction code. <br /> (c) The construction code shall not be construed to relieve from or lessen the responsibility <br /> of any person for damages from any defect, arising out of the ownership, operation, or <br /> installation of any: <br /> (1) Electrical wires, appliances, apparatus, construction, or equipment; or <br /> (2) Plumbing, gas, or drainage systems. <br /> Division 2. Materials, equipment, devices, design, and methods of construction. <br /> Section 5-2-21. Approved materials, equipment, and devices. <br /> Materials, equipment, and devices approved by the authority having jurisdiction shall <br /> be constructed and installed in accordance with such approval. <br /> Section 5-2-22. Used materials, equipment, and devices. <br /> The use of used materials that meet the requirements of the construction code for new <br /> materials is permitted. Used equipment and devices shall not be reused unless approved by <br /> the authority having jurisdiction. <br /> Section 5-2-23. Alternative materials, equipment, design, or methods of construction. <br /> (a) The provisions of the construction code are not intended to prevent the installation of <br /> any material or equipment; or to prohibit any design or method of construction not <br /> specifically prescribed by this code, provided that any such alternative has been <br /> approved by the authority having jurisdiction. <br /> (b) Requests for qualified and approved alternative materials, equipment, design, or <br /> methods of construction shall include a stamped certification from a person who is <br /> licensed in the State of Hawaii as an architect or professional engineer, that the <br /> proposed alternative meets or exceeds the standards set in subsection (c). Supporting <br /> data as prescribed in subsections (d) and (e) shall be required to support the request. <br /> (c) An alternative material, equipment, design, or method of construction may be approved <br /> where the authority having jurisdiction finds that the proposed design is satisfactory <br /> and complies with the intent of the provisions of the construction code, and that the <br /> material, equipment, method, or work offered is, for the purpose intended, at least the <br /> equivalent of that prescribed in this code in quality, strength, effectiveness, fire <br /> resistance, durability, and safety. <br /> 18 <br />
