the Planning Director in accordance with Section 25-2-70, Chapter <br />25 (Zoning Code), Hawai'i County Code.... <br />While the applicant addressed a number of those conditions, as will be <br />described below, plans for Final Plan Approval could -not be finalized. <br />This was due in large measure to the collapse of the market <br />associated with the recession in 2008. As such, the applicant applied <br />for and secured an administrative time extension to August 5, 2015. <br />(See Exhibit C) <br />The applicant is now proposing to renew this extension request for an <br />additional five (5) years, beginning the effective date of this <br />amendment to commence construction and having it substantially <br />completed within ten (10) years, be it either for the commercial or <br />residential component. <br />Furthermore as noted earlier, because of the need to still secure the <br />appropriate financing (subsequent to receipt of any time extension); <br />the need and time to address the multitude of conditions of the <br />ordinance such as affordable housing, sewer evaluation, <br />archaeological/cultural approvals, and the like; and the vagaries of the <br />real estate market relative to commercial uses, the applicant may not <br />be in a position to commence let alone complete the project within the <br />next 5 years. As such, it is also requesting the possibility of an <br />administrative time extension with a 10 -year completion window. <br />Proposed lanquage <br />C. Construction of the proposed development, whether the <br />commercial or residential component shall [be completed] <br />commence within five (5) years from the effective date of <br />this ordinance and be substantially completed within ten <br />10 ears. Prior to construction, the applicant, successors <br />or assigns shall secure Final Plan Approval for the <br />amended proposed development from the Planning <br />Director in accordance with Section 25-2-70, Chapter 25 <br />(Zoning Code), Hawaii County Code.... <br />D. No single commercial business may contain more than 45,000 <br />square feet in gross floor area. <br />This will be complied with and verified during the Plan Approval <br />process. <br />E. If the Department of Transportation requires an amended Traffic <br />Impact Analysis Report (TZAR), it shall be submitted to the <br />Department of Transportation for review and approval prior to the <br />M <br />
