AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 4, OF THE HAWAII COUNTY <br />CODE 1983 (2016 EDITION, AS AMENDED), BY ADDING A NEW SECTION <br />RELATING TO FISCAL IMPACT STATEMENTS. <br />BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br />SECTION 1. Chapter 2, article 4, of the Hawaii County Code 1983 (2016 Edition, as <br />amended), is amended by adding a new section to be appropriately designated and to read as <br />follows: <br />"Section 2- . Fiscal impact statements. <br />(a) "Fiscal impact statement" means a concise assessment of the immediate and <br />potential future effects a proposed ordinance may have on revenues, expenditures, <br />taxes, and fiscal liabilities. <br />(b) A fiscal impact statement for a proposed ordinance that affects the revenues, <br />expenditures, taxes, and fiscal liabilities of the County may be initiated by the <br />director of finance at any time, or upon a council member's written request <br />submitted to the director of finance no later than 4:30 p.m. on the date of the first <br />required council readingof the proposed ordinance. The director of finance shall <br />submit the fiscal impact statement to the council no later than noon on the <br />business day prior to the second required council reading. Nothing in this section <br />shall be construed to limit the ability of the council to act on a proposed ordinance <br />in the absence of a requested fiscal impact statement. <br />(c) This section shall not apply to any proposed ordinance to amend the Hawaii <br />County Charter or to establish the operating budget or capital budget for the <br />followingfiscal year." <br />SECTION 2. New material is underscored. In printing this ordinance, the underscoring <br />need not be included. <br />SECTION 3. Severability. If any provision of this ordinance, or the application thereof <br />to any person or circumstance, is held invalid, the invalidity does not affect other provisions or <br />applications of the ordinance which can be given effect without the invalid provision or <br />application, and to this end the provisions of this ordinance are severable. <br />SECTION 4. This ordinance shall take effect sixty days after approval. <br />2 <br />
