Committee on Finance <br />of Bill No. 207; <br />An Ordinance Relating to the Management of Solid Waste in the County of <br />Hawaii, that Amends the Following Provisions of the Hawaii County Code 1983 <br />(2016 Edition, as Amended): <br />1) Chapters 2, Article 40 (Department of Environmental Management); <br />2) Chapter 14, Article 20 (Plastic Bag Reduction); New Article 24 (Littering); <br />New Article 25 (Clearing Occupied and Unoccupied Lots); and <br />3) Chapter 20 (Refuse), New Chapter 20 (Integrated Solid Waste Management). <br />Please see below a proposed amendment to subsection 20-02-22(a) that is contained in <br />SECTION 3 of Bill No. 207. Section 20-02-22 relates to administrative enforcement. These <br />amendments are illustrated in Ramseyer format with respect to the contents of Bill No. 179, <br />Draft 2. Material to be deleted is bracketed and stricken; new material is underscored. <br />"(a) If the director determines that any person has violated or is violating any provision of this <br />chapter or department rules, the director shall serve a notice of violation and order upon the <br />parties responsible for the violation, which shall include the following: <br />(1) [Thedate]Date of the notice; <br />(2) [The Name and address of the person noticed [and the leeienfthe-vielatien]; <br />(3) [T -he seven] Section number of the code or rule which has been violated; <br />(4) [The] Date, time, location, and nature of the violation; <br />(5) [Coffee ] Deadline to correct the violation [tet-iin the time speeified in the order]; <br />(6) [Bay] To pay a civil fine not to exceed $1,000 in the manner, place and deadline <br />specified in the order; <br />(7) [Pay] To pay a civil fine not to exceed $1,000 per day for each day in which the <br />violation persists, in the manner, time, place and deadline specified in the order; <br />(8) Any other consequence as determined by the director, including but not limited to, <br />suspension or revocation of a permit; and 'Comm.
