COUNTY OF HAWAII STATE OF HAWAII <br /> OF <br /> BILL NO. 217 <br /> (DRAFT 2) <br /> ORDINANCE NO. <br /> AN ORDINANCE AMENDING CHAPTER 24,ARTICLE 10,DIVISION 4, <br /> SECTION 24-278 OF THE HAWAII COUNTY CODE 1983 (2016 EDITION,AS <br /> AMENDED), RELATING TO PEDESTRIANS. <br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br /> SECTION 1. The purpose of this amendment is to improve safety upon that <br /> portion of Waipi'o Valley Road running from the Waipi'o Valley lookout to a point near <br /> its entry upon the valley the floor. <br /> SECTION 2. Chapter 24, article 10, division 4, section 24-278, schedule 26, <br /> Roads closed to pedestrian traffic, subsection (a), Hdmdkua, of the Hawaii County Code <br /> 1983 (2016 Edition, as amended), is amended by adding the following to be appropriately <br /> designated and to read as follows: <br /> Lj Waipi'o Valley Road, from a point approximately nine hundred <br /> thirty feet northwest of Kukuihaele Road and extending <br /> approximately nine thousand three hundred feet in the <br /> northwestern direction. This restriction shall not apply: <br /> - In case of emergency. <br /> - To owners, lessees, and residents of Wai-pi'o Valle <br /> - To Native Hawaiian cultural practitioners in exercise of their <br /> traditional and customary rights. <br /> SECTION 3. New material is underscored. In printing this ordinance, the <br /> underscoring need not be included. <br /> SECTION 4. Severability. If any provision of this ordinance, or the application <br /> thereof to any person or circumstance, is held invalid, such invalidity shall not affect <br /> other provisions or applications of the ordinance which can be given effect without the <br /> invalid provision or application, and to this end, the provisions of this ordinance are <br /> declared to be severable. <br /> SECTION 5.
