<br /> KNOW ALL MEN BY"THFSF PRESENTS:
<br /> THAT the HILO HILLSME, LLC, a Hawaii limited liability company, whose
<br /> mailing address is 1050 Bishop Street, Suite 252. Honolulu, Hawaii 96813, hereinafter called
<br /> the "Grantor", for and in consideration of the sum of TEN AND -NO/100 DOLLARS ($10.00)
<br /> and other valuable consideration to them paid by the COUNTY OF HAWAN, a niunicipa/
<br /> corporation of the State of Uawai'i, whose principal place of business and mailing address is
<br /> 25 Aupuni Street, Hilo, Hawaii 96720, hereinafter called the "Grantee," the receipt of which is
<br /> hereby acknowledged, does hereby grant, bargain, sell and convey unto the Grantee, its
<br /> successors and assigns, in fee simple, forever, that certain roadway parcel, situate at Kukuau 1st,
<br /> District of South Hilo, County of Hawai'i, State of Hawaii being further identified as follows:
<br /> Roadway Lot 398, as shown on Map 94 of Land Court_Application
<br /> No. 1205 (containing an area of 0.611 acre), being Tax Map Key •
<br /> No.: (3) 2-4-075:070, more particularly described in Exhibit A
<br /> attached hereto,.and as shown on the map attached hereto as
<br /> Exhibit 13, hereinafter (the "Property").
<br /> TO HAVE AND TO HOLD the same, together with all rights, improvements, easements,
<br /> privileges and appurtenances thereunto belonging or in anywise appertaining, or held and
<br /> enjoyed therewith, unto the Grantee, its successors and assigns, in fee simple, forever.
<br /> AND Grantor does hereby covenant with the Grantee, its successors and assigns, that
<br /> they are seised in fee simple of the above-described Property; that the same is free and clear of
<br /> and from all encumbrances, except as aforesaid; that it has good right to sell and convey the
<br /> same as aforesaid; and that it will, and its successors and assigns will WARRANT AND
<br /> DEFEND the same unto the Grantee, its successors and assigns, forever, against the lawful
<br /> claims and demands of all persons whomsoever.
<br /> The parties to this instrument understand that the person or company recording or
<br /> arranging for the recordation of this instrument is authorized to complete any blanks contained in
<br /> this instrument with the applicable number of pages, dates and recordation information, whether
<br /> before or after this instrument has been notarized by a notary public, and in no event shall
<br /> completion of any such blanks be deemed to be an alteration of this instrument by means of the
<br /> insertion of the new content.
