Mr. Zendo Kern, Acting Planning Director <br /> Page 9 of 16 <br /> December 15, 2020 <br /> C) that construction commence within one(1)year from the date of receipt of Final Plan <br /> Approval and be completed within two (2)years thereafter; <br /> Applicant's Statement of Position: same discussion as offered for Conditions A and B <br /> above. <br /> D) that access to the property shall meet with the approval of the Department of Public <br /> Works; <br /> Applicant's Statement of Position: this condition is redundant, as it recites requirements <br /> already enforced by the County of Hawai`i through Chapter 22,Article 4 of the Hawai`i <br /> County Code, more specifically Section 22-4.8(a)which states that, "No County street <br /> shall be used for ingress or egress to a property without a properly located and <br /> constructed driveway approach." Regarding improvements along the street frontage of <br /> the subject property,please note that there are no sidewalks along the makai side of <br /> Kinoole Street directly fronting other similarly zoned commercial properties on either <br /> side of the subject property. The existing Kagimoto's store directly adjacent to the south <br /> utilizes its street frontage as an active parking area,that could complicate pedestrian <br /> movements should sidewalk improvements be required along the street frontage of the <br /> subject property. The adjoining property to the north maintains a similar"legacy"CN-10 <br /> zoning and is therefore not subject to any sidewalk improvements. Please refer to <br /> Figures 6, and 9 showing the existing Kinoole Street conditions along the front of the <br /> subject and adjoining properties. <br /> E) that the proposed improvements shall be designed in keeping with the existing character <br /> of the immediate neighborhood; <br /> Applicant's Statement of Position: there are no specific design guidelines established <br /> within the particular section of the City of Hilo. Therefore,the Applicant is not aware of <br /> what design vernacular should be applied or adhered to. The adjoining Kagimoto's store <br /> does have a particular building design typical of late 19th century and early 20th century <br /> architecture found in abundance in Downtown Hilo, but contemporary-styled buildings <br /> abound on almost every other commercial-zoned property in the immediate vicinity of <br /> the subject property, including an apartment building,two gas station complexes and <br /> Waiakeawaena Elementary School complex. Figures 6 through 12 below identifies the <br /> existing architectural setting and basic urban character of this particular area at the <br /> intersection of Kinoole and Kawailani Streets. <br />
