Open space is regulated by the Zoning Code through minimum yard <br /> setback and maximum height requirements; minimum parking requirements are also <br /> regulated by the Zoning Code, and landscaping requirements are administered through <br /> Planning Department Rule No. 17 regarding Landscaping. <br /> G) that the sewage requirements of the appropriate governmental agencies shall be complied <br /> with; <br /> Applicant's Statement of Position: the subject property and this particular area within the <br /> City of Hilo is not serviced by a public sewer system. An individual wastewater <br /> treatment system, regulated by the State Department of Health through its Wastewater <br /> Systems rule (Title 11, Chapter 62, Hawai`i Administrative Rules). <br /> H) that all water runoff generated by the proposed development shall be disposed of by a <br /> drainage system acceptable to the Department of Public Works; <br /> Applicant's Statement of Position: water runoff caused by development of the subject <br /> property will be regulated by the County of Hawail through its Erosion and <br /> Sedimentation requirements within Chapter 10 of the Hawaii County Code and in <br /> accordance with the Department of Public Works Storm Drainage Standards. If <br /> applicable,the State Department of Health-Clean Water Branch through its National <br /> Pollutant Discharge Elimination System (NPDES)requirements may also be part of the <br /> overall review and approval process related to development-generated runoff and its <br /> proposed disposal. <br /> I) that all other applicable rules, regulations and requirements be complied with. Should any <br /> of the foregoing conditions not be met, rezoning of the area to its original or more <br /> appropriate designation may be initiated. <br /> Applicant's Statement of Position: given that more than half of the property maintains an <br /> existing CN-10 zoning that has existed for more than 53 years,the Applicant would like <br /> to assume that maintaining the CN-10 zoning for the remainder of the property covered <br /> by Ordinance No. 81-723 is appropriate due to its consistency with the General Plan and <br /> the existing commercial land use pattern at this major intersection within the City of Hilo. <br />
