As <br /> requested by the petition, one hundred percent(10010) of the above-referenced properties are <br /> seeking to establish a community facilities district(CFD) for the purpose of constructing a sewer <br /> line extension from the subject property to the Kealakehe Wastewater Treatment Plant. <br /> As a brief background, on March 28, 2019, the Council adopted resolution No. 86-19, <br /> which authorized the construction of the extension and contemplated that the construction would <br /> occur by way of improvement district(ID). A copy of Resolution No. -19 is enclosed herewith <br /> for reference purposes. On March 11, 2020, the Council adopted Resolution No. 502-20, <br /> authorizing the initiation of proceedings for the formation of an improvement district pursuant to <br /> Chapter 12, Hawaii County Code, a copy of which is also included for reference purposes. <br /> After the adoption of resolution No. 502-20, the Petitioners' and the County's team of <br /> consultants concluded that the CFD process would better accommodate the proposed <br /> development phases and would provide a more equitable and flexible method for assessing future <br /> lot owners for the costs associated with the construction and funding of the sewer line. <br /> A primary reason for submittal of this petition at this time is to allow for the timely <br /> completion of the sewer line extension in conjunction with the completion of a 100 unit <br /> affordable housing project to be built by the Hawaii Island Community Development <br /> Corporation(HICDC) on lands located at TMK: (3) 7-3-009:032 in order to allow HICDC to <br /> connect to the sewer line when its affordable housing project is completed. While the affordable <br /> housing project would pay for future sewer service fees, that project is not included in the CFI) <br /> areas to be assessed for the costs of construction and financing. <br />
