DARROW: Thanks, Chair Vitousek. So kind of wrapping things up and working on the <br /> conditions that we could provide for the commission, I've been kind of texting with Christian. <br /> As far as the preservation, it appears that if we just remove Condition M—is it, Christian? <br /> KAY: (Nods in the affirmative) <br /> DARROW: —which was the option for data recovery, then it would be back to Condition L, <br /> which would be focusing on the preservation. You may have to reword that a little bit in the <br /> beginning where it says, "Should the applicants choose"; so at this point there is no more choice. <br /> The other condition that I mentioned earlier that would basically replace Condition J, which <br /> states simply, "`Ohara dwellings, if approved by the Planning Department, shall be serviced by <br /> individual water meters as approved by the Department of Water Supply"; so that would take <br /> over,that would remove Condition J and then be added. And again, we are aware that they are <br /> limited to one additional water unit from the Department of Water Supply, so that basically <br /> would be where they are at. Now, again,keeping in mind that in the future if more water comes <br /> into the area, then they have the ability to add additional dwellings. <br /> Then we had talked about the simple minor changes on Condition C, "application"to <br /> "applicant," and Condition N to remove"unlikely." <br /> If Christian can reword Condition M, maybe what we can do is take out the one and add in the <br /> roadway condition requirements that you are asking for. And then we, it sounds like we should <br /> be close. <br /> VITOUSEK: Okay, yeah, I'm really,I think that's great, and at this point I would like to move <br /> towards a motion and then these can be discussed. Commissioner Van Pernis. <br /> VAN PERNIS: Yes, I believe that the applicant has agreed to limit the possibility of`ohana, so <br /> did the Planning Department, to Lots 5 and 6, and that should be stated in what the Planning <br /> Department has talked about. <br /> VITOUSEK: Okay, I think we are getting into discussion, and I would really like to have a main <br /> motion on the floor before we get into discussion on the revisions of the conditions. So,would <br /> someone like to make a motion to recommend favorable or unfavorable? <br /> KAY: Mr. Chair, I'm sorry,before you get started, we have two items on the agenda; I don't <br /> know if you want to take the state land use boundary amendment first and then get into the <br /> rezone, which seems to be the meat of the condition changes. <br /> VITOUSEK: Yeah, I agree, I think that we should move with the amendment to the state land <br /> use boundary first, get a motion on that. <br /> KAY: Barbara has her hand raised. <br /> VITOUSEK: Commissioner DeFranco. <br /> 16 <br /> DRAFT <br />
