(33) Subsection R320.1, "Scope," of the International Residential Code is amended to <br /> read as follows: <br /> "R320.1 Scope. Where there are four or more dwelling units or sleeping <br /> units in a single structure, the following provisions [of Chapter 11 of the <br /> International Building Code] for Group R-3 [shall] apply: <br /> 1. For construction of buildings or facilities of the State and County <br /> governments, compliance with Section 103-50, Hawai`i Revised Statutes, <br /> administered by the Disability and Communication Access Board, State of <br /> Hawai`i. <br /> 2. Department of Justice's Americans with Disabilities Act Standards for <br /> Accessible Design. <br /> 3. Housing and urban development recognized "safe harbors" for compliance <br /> with the Fair Housing Acts design and construction requirements. <br /> 4. Other pertinent laws relating with disabilities shall be administered and <br /> enforced by agencies responsible for their enforcement. <br /> Prior to the issuance of a building permit, the owner (or the owner's <br /> representative, professional architect, or engineer), shall submit a statement <br /> that all requirements relating to accessibility for persons with disabilities will be <br /> complied with." <br /> (34) Subsection R322.2, "Flood hazard areas (including A Zones)," of the International <br /> Residential Code is amended to read as follows: <br /> "R322.2 Flood hazard areas (including A Zones). [Areas that have been <br /> determined to be prone to flooding and that are not subject to high velocity wave <br /> been delineated ac subject to wave heights between 1 feet (457 mm) and 3 feet <br /> (914 mm) or otherwise designated by the jurisdiction shall be designated as <br /> Buildings and structures constructed in whole or in part in flood hazard ar nJ <br /> shall be designed and constructed in accordance with Sections R322.2.1 through <br /> R322.2.3.] Buildings located within areas of special flood hazards pursuant to <br /> Chapter 27, Hawai`i County Code, shall be designed and constructed in <br /> accordance with Chapter 27, Hawaii County Code." <br /> (35) Section R323, "Storm Shelters" of the International Residential Code, is amended <br /> to read as follows: - <br /> "SECTION R323 <br /> [STORM-SHELTERS] HAWAII RESIDENTIAL SAFE ROOMS <br /> R323.1 General. This section applies to storm shelters where constructed as <br /> separate detached buildings or where constructed as safe rooms within buildings <br /> 26 <br />
