NO . <br /> S.D. 1 <br /> "Private entity" means a business organization duly <br /> 2 authorized to transact business in the State that: <br /> (1) Possesses a certificate of need provided to the <br /> wastewater recovery facility' s operator needed to <br /> 5 design, construct, maintain, and operate a wastewater <br /> treatment plant, and is able to demonstrate the <br /> 7 successfulness of the resource recovery facility <br /> pursuant to chapter 340A; or <br /> 9 (2) Is the sole member of a nonprofit management entity. <br /> 10 "Transfer completion date" means the date specified as the <br /> 11 any extensions allowed under the terms of the agreement. <br /> 12 "Transferred facility" means a wastewater treatment <br /> 13 facility within the state of Hawaii for which the right and <br /> 14 responsibility to design, construct, manage, operate, and <br /> 15 otherwise provide wastewater treatment services at the facility <br /> 16 is transferred to a private entity or its nonprofit management <br /> 17 entity pursuant to this part. <br /> 18 §46-B Transfer of rights and responsibility to manage, <br /> 19 operate, and provide wastewater treatment services in a facility <br /> 20 of the county' s wastewater treatment system to a nonprofit <br /> 21 management entity.
