Maile David, Council Chair <br /> and Members of the County Council <br /> County of Flawai`i <br /> December 27, 2021 <br /> Page 2 <br /> • Condition N (roadway/driveway requirements related to the development of TMK <br /> 7-4-008:077): The Commission replaced the trigger for completing construction of the <br /> Kamanu Street Extension from, "...prior to issuance of Certificate of Occupancy on any <br /> structure within the area" to, "prior to Final Subdivision Approval" should Parcel 77 be <br /> further subdivided. <br /> • The Commission allowed staff to correct non-substantive clerical errors in the proposed <br /> conditions, including the Ramseyer underlining of new Conditions N and O. <br /> The ordinance conditions attached to this letter reflect the Commission changes discussed above. <br /> The Commission concurs with the following Planning Director's reasons for recommending a <br /> favorable consideration of the request: <br /> The applicant is requesting to amend Condition J (Kamanu Street construction <br /> timing) of Ordinance No. 18 115 to delete language related to alternative financing for <br /> and phasing of the construction of the Kamanu Street Extension and adding reference to <br /> two (2) new conditions (Condition N and Condition O) as exceptions to the requirement <br /> to complete construction of Kamanu Street prior to Certificate of Occupancy (CO). The <br /> requested amendment language is as follows. Material to be deleted is bracketed and <br /> struck through; new material is underlined: <br /> J. Prior to the issuance of a Certificate of Occupancy of any structure within the <br /> project area, except as provided in Conditions K, L, fes] M N, and O, below, <br /> Kamanu Street Extension shall be constructed and available for use across the <br /> entire project area. The applicant shall construct Kamanu Street extending from <br /> the north property boundary to the south property boundary except as provided in <br /> Condition N, below, meeting with the approval of the Department of Public <br /> Works.
