and to make sure that the new Kumu Hou project participated in that is that conditions of <br /> approval to require coordination with the overall water quality monitoring program for these new <br /> areas as well. So, it's not just during construction but also this will be, I believe that's, this <br /> program has been going on for about 30 years and will continue to go on in perpetuity in the <br /> future. So, this water quality monitoring program is done by Waikoloa and the landowners <br /> within the resort, and then reviewed by the Planning Department and State Department of <br /> Health. Should there be any degradation in water quality,then the State Department of Health <br /> requirements would be met to mitigate that, those, those issues. <br /> ARMBRUSTER: Okay. <br /> KAY: Hope that's helpful. <br /> ARMBRUSTER: Yes. So,basically we're just tying this new SMA into an ongoing program. <br /> KAY: Yeah,that's correct. So,because we were pulling it out of SMA 25 we wanted to make <br /> sure it was covered so all of the new SMA permits have a requirement to ensure that the new <br /> areas or Kumu Hou participates in the overall water quality monitoring program and that the <br /> program is actually amended to include the new developments. <br /> ARMBRUSTER: Okay. Okay. And then one more thing about the traffic. I saw there was a little <br /> bit of some simple brain opinions there with DOT, and the road widening, and how, how future <br /> traffic is, is accommodated and that we were still, we were still looking for some revised, I think, <br /> data about that? Has that been--do we have that yet? <br /> FUKE: Well, actually— <br /> ARMBRUSTER: [unintelligible speech] <br /> --without the road widening. <br /> BOUSLOG: I, I can respond to that and I, and I have our engineer here if you need any more <br /> detailed beyond my, my knowledge. But Wilson Okamoto did the traffic impact report for us, <br /> which I didn't realize initially when we got the letter from DOT, but they had not assumed the <br /> widening of Queen Ka`ahumanu Highway until 2045. Stuff wasn't maybe clear to DOT when <br /> they read the report. We are aware that DOT plans to widen Ka`ahumanu Highway and they <br /> would like to have that done,but because it was not funded, Wilson Okamoto did not program <br /> that into their models until 2045. <br /> The projection is that the project will pretty much be built out by that time so, effectively all of <br /> the projections that Wilson Okamoto did, except for that we know maybe last period in 2045 are <br /> without widening of Queen Ka`ahumanu Highway. And what they did show is that while there's <br /> some little bit of traffic associated with this project,because there's a lot of sympathetic things, if <br /> you will, in the resort people tend to go to things within the resort and they're not commuting at <br /> the time,the rest of us locals would go to work or pick up your kids and that sort of thing, there <br /> is some traffic going onto the highway,but most of the changes in conditions on Queen <br /> 26 <br /> EXHIBIT D <br />
