The Applicant shall offer at no cost any of its ownership of that portion of the <br /> Kings Highway Foot Trail (SHPD #50-10-10-21173) that bisects the Waikoloa <br /> Beach Resort to the appropriate entity of the State and/or Federal Government. <br /> Evidence of this offer shall be provided to the Planning Department prior to or in <br /> conjunction with the submittal of any Site Plan Approval in the area covered by <br /> this ordinance. <br /> SECTION 3. Severability. If any provision of this ordinance, or the application thereof <br /> to any person or circumstance, is held invalid, the invalidity does not affect other provisions or <br /> applications of the ordinance which can be given effect without the invalid provision or <br /> application, and to this end the provisions of this ordinance are severable. <br /> SECTION 4.
