A RESOLUTION TRANSFERRING/APPROPRIATING AN APPROPRIATION OUT AND FROM A DESIGNATED FUND ACCOUNT AND CREDITING SAME TO A DESIGNATED FUND ACCOUNT TO PROVIDE A GRANT TO WEGO FOUNDATION INC., FOR THE RENTAL OF A PORTABLE BATHROOM FOR BANYAN BEACH IN KONA. WHEREAS, WeGo Foundation Inc., is a 501(c)(3) nonprofit organization whose goal is to provide a support network for athletically talented and needy youth from broken homes in our community, and help them pursue their passion and become productive citizens; and WHEREAS, Banyan Beach is a very popular surf spot for locals and tourists; but there is no bathroom facility available for the public; and WHEREAS, WeGo Foundation Inc., strives to protect the environment and public health and safety; and WHEREAS, WeGo Foundation Inc., is requesting funds for the rental and cleaning of an ADA (Americans with Disabilities Act) portable bathroom, which will be placed in the public access area to Banyan Beach; and WHEREAS, the Department of Public Works strives to protect the environment and promote public health and safety; and WHEREAS,pursuant to Section 2-139(a)(2)(A) of the Hawaii County Code, Contingency Relief funds shall be transferred to an accepting County department/agency via resolution identifying the nonprofit organization and the specific program, project, event, activity, service, equipment, materials, or supplies for which the grant shall be used; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that Contingency Relief funds from Council District 7 will be appropriated to the Department of Public Works to provide a grant to WeGo Foundation Inc., for the rental of an ADA portable bathroom for Banyan Beach in Kona. BE IT FURTHER RESOLVED that the Council of the County of Hawaii hereby transfers/appropriates the following amount as set forth below:
