STATE OF G <br /> E•QF NF' 3 <br /> SOLUTION NO. 467 22 <br /> 3 <br /> i <br /> A RESOLUTION REQUESTING THE OFFICE OF THE COUNTY AUDITOR TO <br /> CONDUCT A PERFORMANCE AUDIT OF THE OFFICE OF HOUSING AND <br /> COMMUNITY DEVELOPMENT TO ENSURE THAT THE AGENCY HAS ADEQUATE <br /> FUNDAMENTAL AND STRATEGIC PLANS TO GUARANTEE THE LAWFUL AND <br /> EFFICIENT ISSUANCE AND UTILIZATION OF AFFORDABLE HOUSING CREDITS. <br /> i <br /> t <br /> WHEREAS, Section 2-70 of the Hawaii County Code provides in part that the housing <br /> administrator may carry out powers to "develop and construct dwelling units, alone or in <br /> partnership with developers; provide assistance and aid to a public agency or person in <br /> developing and constructing new housing and rehabilitating old housing for the elderly of low <br /> income, other persons of low income...and contract with any eligible bidders to provide for <br /> construction of urgently needed housing for persons of low income..."; and <br /> WHEREAS, Section 2-71 of the Hawaii County Code provides in part that"the housing <br /> administrator shall have direct responsibility for the administration and operation of the County <br /> housing programs..."; and <br /> WHEREAS, Section 11-4(a) of the Hawaii County Code provides for the imposition of <br /> affordable housing requirements when certain types of change of zoning district designations are <br /> enacted by ordinance; and <br /> WHEREAS, Section 11-4(a) of the Hawaii County Code further provides that <br /> affordable housing requirements shall apply to all "prior rezoning actions which contain <br /> affordable housing conditions that have not been satisfied as of February 5, 2005, or to which the <br /> County has not agreed previously as to the specific means of satisfying the requirements"; and <br /> WHEREAS, Section 11-4, subsections (b) through (d), of the Hawaii County Code <br /> enumerate how affordable housing requirements may be satisfied by the accumulation of <br /> affordable housing credits; and <br /> WHEREAS, Section 11-5(c) of the Hawaii County Code establishes a schedule by <br /> which affordable housing credits may be earned; and <br /> WHEREAS, affordable housing credits are administered by the Office of Housing and <br /> Community Development; and <br /> WHEREAS, there have been many concerns expressed from individuals and <br /> organizations urging the need for an audit of the Office of Housing and Community <br /> Development to ensure that the agency has adequate fundamental and strategic plans to <br /> guarantee lawful and efficient issuance and utilization of affordable housing credits; now, <br /> therefore, <br />
