i <br /> i <br /> 4°�~YYr®P pp�$Y <br /> 4.•L Zt`Ji�; <br /> COUNTY OF G +a. n _� STATE OF G <br /> ''Tp'QF'Mp� <br /> SOLUTION NO. 47 6 22 <br /> RESOLUTIONAUTHORIZING THE PAYMENT OF FUNDS FROM THE <br /> APPROPRIATIONS OF A LATER FISCAL YEAR FOR A LEASE OF REAL <br /> PROPERTY FOR THE COUNTY OF HAWAII MASS TRANSIT AGENCY <br /> WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or other <br /> obligation requiring payment of funds from the appropriations of a later fiscal year or of more than one <br /> fiscal year be approved by resolution; and <br /> WHEREAS, the Mass Transit Agency desires to lease a commercial space situated at Kings' <br /> Shops, Waikoloa, Hawaii 96738, from KS Owner, LLC ("Landlord"); and <br /> WHEREAS, this space will allow for the parking of up to ten(10) buses and provide a <br /> breakroom and rest area for Hele-On bus operators; and <br /> WHEREAS, the Mass Transit Agency desires to enter into a lease agreement that is <br /> anticipated to commence on September 1, 2022, for twelve (12) months with the option to extend the <br /> lease for an additional one (1)year with Landlord; and <br /> WHEREAS, the Mass Transit Agency is requesting authorization for the Mayor to enter into a <br /> lease agreement with payments of funds from the appropriations of a later fiscal year; now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that pursuant <br /> to section 10-11 of the Hawaii County Charter, the Mayor is hereby authorized to enter into a lease <br /> agreement with KS Owner, LLC for one (1)year with options as indicated above for the Mass Transit <br /> Agency. <br />
