(Appendix B) SHPD also <br /> approved the AMP in its letter, dated June 24, 2021. (Appendix C) <br /> G. Valued Cultural Resources <br /> The recent Hawaii State Supreme Court's "PASH" and "Ka Pa'alcai <br /> 0 Ka'Aina"decisions require decision-makers to consider a <br /> project's impact to native Hawaiian gathering and fishing rights. <br /> Specifically, there must be a discussion of the cultural, historical, <br /> and natural resources and associated traditional and customary <br /> practices of this site and the impact of this project to these <br /> resources and practices. <br /> In this situation, the subject site is not adjacent and/or proximate to <br /> the shoreline. As such, fishing and coastal access is not an issue. <br /> Furthermore, as noted in the floral and faunal analysis, there are no <br /> known rare or endangered plants or animal life. Since owning the <br /> site for over 20+ years, the applicant has not observed any native <br /> Hawaiians gathering plants within or proximate to the subject site. <br /> As such, it would appear very unlikely that the site would serve <br /> such purpose today and/or in the recent past. <br /> Nonetheless, if legitimate claims are made, the applicant will make <br /> the appropriate access accommodations. <br /> Furthermore, the site has been cleared archaeologically, and there <br /> were no known sites on this property that required preservation. In <br /> conjunction with any land disturbance activities, the protocols of the <br /> approved Archaeological Monitoring Plan will be adhered to. Thus, <br /> in the event inadvertent discoveries are made, the protocols <br /> outlined in the AMP will be followed. These include stopping work <br /> and making contacts and determining appropriate courses of action <br /> with the SHPD. <br /> Based on the above, it does not appear that the project would have <br /> any potential adverse impacts relating to native Hawaiian cultural <br /> and historical resources and/or practices. <br /> s <br />
