P. The Applicant shall comply with all applicable County, State, and Federal codes, <br /> 3 <br /> laws, rules, regulations, and requirements for the proposed development, <br /> I <br /> including the State Department of Health. <br /> 3 <br /> 3 <br /> Q. An initial extension of time for the performance of conditions within the <br /> ordinance may be granted by the Director upon the following circumstances: <br /> i <br /> 3 <br /> I <br /> a. The non-performance is the result of conditions that could not have been <br /> 3 <br /> foreseen or are beyond the control of the Applicant, successors, or assigns, <br /> 3 <br /> and that are not the result of their fault or negligence. <br /> 'i <br /> 3 <br /> b. Granting of the time extension would not be contrary to the General Plan <br /> or Zoning Code. <br /> 1 <br /> C. Granting of the time extension would not be contrary to the original <br /> reasons for the granting of the change of zone. <br /> d. The time extension shall be for a period not to exceed the period originally <br /> i <br /> granted for performance (i.e., a condition to be performed within one year <br /> may be extended for up to one additional year). <br /> 3 <br /> If the Applicant should require an additional extension of time, the Planning <br /> I <br /> Director shall submit the Applicant's request to the County Council for <br /> appropriate action. <br /> 3 <br /> 3 <br /> 33 <br /> I <br /> R. Should any of the conditions not be met or substantially complied with in a timely <br /> fashion, the Planning Director may initiate rezoning of the area to its original or <br /> more appropriate designation. <br /> I <br /> 3 <br /> 3 <br /> I <br /> 3 <br /> i <br /> 3 <br /> -9- <br /> I <br /> I <br /> I <br /> 3 <br /> 3 <br /> 3 <br />
