REPORT OF THE <br /> COMMITTEE ON PUBLIC WORKS AND MASS TRANSIT <br /> DATE: September 6, 2022 Re: Comm.No. 946/Bill No. 203 <br /> PLACE: Council Chambers <br /> Hilo, Hawai`i <br /> TIME: 2:18 p.m. <br /> Council Chair and Members <br /> Hawai`i County Council <br /> Hilo, Hawai`i <br /> Your Committee on Public Works and Mass Transit, to which was referred Bill No. 203, reports as <br /> follows: <br /> Bill No. 203,transmitted by Public Works Acting Director Stephen Pause, via Communication No. 946 <br /> dated August 3, 2022, amends Chapter 24, Article 10, Division 8, of the Hawai`i County Code 1983 <br /> (2016 Edition, as amended), relating to the use of certain streets by certain vehicles restricted. <br /> This bill amends Section 24-293, Schedule 41, by repealing Subsection (f)(2), which prohibits vehicles <br /> with a gross vehicle weight rating of five or more tons from using Kaiminani Drive in North Kona. <br /> Deputy Corporation Counsel Sinclair Salas-Ferguson appeared before Your Committee and explained <br /> the amendment removes the vehicle weight restriction for Kaiminani Drive in the North Kona District. <br /> Acting Director Stephen Pause explained the current Chapter 24 prohibits certain vehicles from <br /> traveling on Kaiminani Drive when they have a gross weight rating'of five or more tons,however, he <br /> said the department has determined the weight restriction is unnecessary because the roadway is <br /> designed and built to accommodate vehicles of five or more tons: He also explained the impetus for this <br /> was to clean up the Code and allow for the use of mass transit vehicles. <br /> Your Committee on Public Works and Mass Transit is in accord the purpose and intent of <br /> Bill No. 203, and recommends its passage on first reading. <br /> SO <br /> AYES NOES ABS EX Respectfully submitted, <br /> CHUNG X <br /> DAVID x COMMITTEE ON PUBLIC WORKS <br /> INABA X A D MA _ L IT <br /> KANEALLEINFELDER X ' <br /> '‘.
