1 <br /> Oc <br /> COUNTY OF HAWAIII STATE OF HAWAIII <br /> gra tiF.t+�•N <br /> RESOLUTION NO. 564 22 <br /> A RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL <br /> YEAR AND OF MORE THAN ONE FISCAL YEAR FOR A MULTI-YEAR LICENSE <br /> AGREEMENT WITH THE TRUSTEES OF THE ESTATE OF BERNICE PAUAHI <br /> BISHOP FOR THE ENTRY AND USE OF A PORTION OF TK(3)9-3-001-006 FOR <br /> THE SOUTH POINT TOWER. <br /> WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or <br /> other obligation requiring payment of funds from the appropriations of a later fiscal year or of <br /> more than one fiscal year be approved by resolution; and <br /> WHEREAS, the Trustees of the Estate of Bernice Pauahi Bishop ("Licensor") owns <br /> TMK(3) 9-3-001-006 ("Subject Parcel"); and <br /> WHEREAS, on the Subject Parcel there is a non-manned facility, which includes an 80 <br /> ft. tower ("South Point Tower"), antennae improvements, equipment shelter, generator, propane <br /> tank and fencing; and <br /> WHEREAS, Civil Defense desires to enter into the license agreement to operate and <br /> maintain the South Point Tower for an annual license fee of five thousand dollars ($5,000) plus <br /> GET; and <br /> WHEREAS, Civil Defense is requesting authorization for the Mayor to enter into a <br /> multi-year license agreement with Licensor for the Subject Parcel; now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the <br /> Honorable Mitchell Roth, Mayor of the County of Hawaii, is hereby authorized to enter into a <br /> multi-year license agreement with Licensor, for a five (5)year period commencing March 1, <br /> 2022, and extending through and ending February 28, 2027. <br />
