No. 1054/13ill No. 228 <br /> PLACE: Council Chambers <br /> Hilo, Hawaii <br /> TIME: 3:00 p.m. <br /> Council Chair and Members <br /> Hawaii County Council <br /> Hilo, Hawaii 96720 <br /> Your Committee on Planning, to which was referred Bill No. 228, reports as follows: <br /> Bill No. 228, submitted by Mayor Mitchell D. Roth, via Communication No. 1054, dated <br /> October 3, 2022, amends the State Land Use Boundaries Maps for the County of Hawaii by <br /> changing the district classification from the Agricultural District to the Rural District at Kawaihae, <br /> South Kohala, Hawaii, Covered by Tax Map Key: 6-2-009:015. Bill No. 228 was introduced by <br /> Chair Ashley Kierkiewicz, by request. <br /> The Leeward Planning Commission forwards its favorable recommendation for this amendment to <br /> the State Land Use Boundaries Map and a change of zone, which would allow the applicant to <br /> subdivide the property into two lots, approximately 2.9 acres in size, containing an existing <br /> single-family dwelling on each lot, for estate planning purposes. The applicant is Arte McCollough. <br /> The property is located at 62-2225 and 62-2239 `Ouli Street, at the southwest corner of its <br /> intersection with Kawaihae Road, Kanehoa Subdivision in South Kohala. <br /> Chair Kierkiewicz opened discussion up to both Bills No. 228 and 229 globally. <br /> Planning consultant Daryn Arai was present before Your Committee in the Hilo Chambers to <br /> represent the applicant. He explained that the request is "no-harm, no foul"type of rezone, where <br /> nothing major is changing on the ground. He noted that the general plan designates this area as a <br /> rural community, the subdivision this project is in was established 37 years ago, and that seven <br /> other lots in the subdivision have undergone this same rezoning. Mr. McCollough appeared <br /> before Your Committee in the Hilo Chambers. He explained that he and his wife purchased the <br /> property over 20 years ago, but he did not know about the condominium property regime (CPR) <br /> requirements as he was under the impression, they were only applicable to high-rise condos in <br /> O`ahu. <br /> Committee Member Tim Richards mentioned the CPR issue is an ongoing issue in his district. <br /> He voiced his support for the project and noted that nothing will change other than the <br /> paperwork. <br /> The vote was then taken on the motion to move this measure to Council with a favorable <br /> recommendation and passed with eight"ayes," and Committee Member Chung absent. <br /> PC Report No.: 84 <br />
