REPORT OF THE
COMMITTEE ON PLANNING
DATE: November 1, 2022 Re: Comm. No. 1054/13ill No. 229
PLACE: Council Chambers
Hilo, Hawaii
TIME: 3:00 p.m.
Council Chair and Members
Hawaii County Council
Hilo, Hawaii 96720
Your Committee on Planning, to which was referred Bill No. 229, reports as follows:
Bill No. 229, submitted by Mayor Mitchell D. Roth, via Communication No. 1054, dated
October 3, 2022, amends Section 25-8-7 (North and South Kohala Zone Map), Article 8,
Chapter 25 (Zoning Code) of the Hawaii County Code 1983 (2016 Edition, as Amended), by
changing the district classification from Agricultural—Five Acres (A-5a) to Residential and
Agricultural—Two Acres (RA-2a) at Kawaihae, South Kohala, Hawaii, Covered by Tax Map
Key: 6-2-009:015. The applicant is Arte McCollough. Bill No. 229 was introduced by Chair
Ashley Kierkiewicz, by request.
The Leeward Planning Commission forwards its favorable recommendation for this amendment
to the State Land Use Boundaries Map and a change of zone, which would allow the applicant
to subdivide the property into two lots, approximately 2.9 acres in size, containing an existing
single-family dwelling on each lot, for estate planning purposes. The property is located at
62-2225 and 62-2239 `Ouli Street, at the southwest corner of its intersection with Kawaihae
Road, Kanehoa Subdivision in South Kohala.
Chair Kierkiewicz opened discussion up to both Bills No. 228 and 229 globally.
Planning consultant Daryn Arai was present before Your Committee in the Hilo Chambers to
represent the applicant. He explained that the request is "no-harm, no foul"type of rezone, where
nothing major is changing on the ground. He noted that the general plan designates this area as a
rural community, the subdivision this project is in was established 37 years ago, and that seven
other lots in the subdivision have undergone this same rezoning. Mr. McCollough appeared
before Your Committee in the Hilo Chambers. He explained that he and his wife purchased the
property over 20 years ago, but he did not know about the condominium property regime (CPR)
requirements as he was under the impression they were only applicable to high-rise condos in
O`ahu.
Committee Member Tim Richards mentioned the CPR issue is an ongoing issue in his district.
He voiced his support for the project and noted that nothing will change other than the
paperwork.
The vote was then taken on the motion to move this measure to Council with a favorable
recommendation and passed with eight"ayes," and Committee Member Chung absent.
PC Report No.: 85
