PWMTC-26 Page 2 November 15,2022
Another motion to amend Bill No. 221 with the contents of Communication No. 1029.3 was made
with 8 ayes, Mr. Chung being absent. Said amendment removes paragraphs (19)through (26) of the
bill, relating to the AHJ, and accordingly renumbers the subsequent paragraphs as affected.
A motion to postpone the meeting to the November 15, 2022, meeting was made with 8 ayes with
Mr. Chung being absent. The purpose of the postponement was to move the code in before automatic
adoption without amendments.
Public Works and Mass Transit Meeting of November 15, 2022
Ms. Kierkiewicz provided background on the review and amendments to Bill No. 221, Draft 2,
including those discussions with the Building Division, Fire, Public Works, and Corporation
Counsel.
A motion to amend Bill No. 221, Draft 2, with the contents of Communication No. 1029.7 was made
with 5 ayes, Committee Chair Susan L.K. Lee Loy and Committee Members Holeka Goro Inaba and
Rebecca Villegas being absent. Said amendment defines "new construction."
Committee Member Heather L. Kimball stated concerns with Communication No. 1029.7, suggesting
that clarifications should be made to clearly state that the bill revises Chapter 5 of the Hawaii County
Code. Ms. Kierkiewicz stated that many other sections of the Code operate under the same
assumptions of which concerned chapter is being revised.
Another motion to amend Bill No. 221, Draft 2, with the contents of Communication No. 1029.8 was
made with 5 ayes, Ms. Lee Loy, Mr. Inaba, and Ms. Villegas being absent. Said amendment revises
the fire review plan fees.
Per Committee Member Matt Kdneali`i-Kleinfelder's request, Mr. Todd provided a brief explanation
of how fees are calculated and in which instances they are applied.
Your Committee on Public Works and Mass Transit is in accord with the purpose and intent of
Bill No. 221, Draft 2, as amended to Draft 3, and recommends its passage on first reading.
are
AYES NOES ABS EX Respectfully submitted,
CHUNG X
DAVID X COMMITTEE ON PUBLIC WORKS
INABA x ND MASS TRANSI
KANEALI`I-KLEINFELDER X
KIERKIEWICZ X
KIMBALL X U L.
