2. Granting of the time extension would not be contrary to the General Plan <br /> or Zoning Code. <br /> 3. Granting of the time extension would not be contrary to the original <br /> reasons for the granting of the change of zone. <br /> 4. The time extension granted shall be for a period not to exceed the period <br /> originally granted for performance (i.e., a condition to be performed <br /> within one year may be extended for up to one additional year). <br /> 5. If the applicant should require an additional extension of time, the <br /> Planning Director shall submit the applicants' request to the County <br /> Council for appropriate action. <br /> Currently, following an applicant's written request for an administrative time <br /> extension, Planning Department staff conducts a thorough review to verify compliance <br /> with conditions of the original ordinance and confirms that the request meets the criteria <br /> for granting an administrative time extension listed above. <br /> When necessary, the Planning Department has requested more specific <br /> justification for how the request meets criterion number one (1) or to require completion <br /> of conditions of approval such as payment of water commitment fees, etc. If the applicant <br /> has exceeded the timeframe allowed for requesting an administrative time extension, the <br /> Planning Department forwards the request to the Planning Commission and County <br /> Council. <br /> Finally, if the request is deemed complete and all criteria are satisfied, the <br /> Planning Director does not have the authority to approve an administrative time extension <br /> beyond the amount of time originally granted, in accordance with criteria number five (5) <br /> and any further extension of time would require approval of the County Council. <br /> As with any other proposed condition of approval,the County Council, as the <br /> decision-making body, currently has the ability to modify or remove this administrative <br /> time extension condition and require that the applicant present any request for a time <br /> extension directly to the County Council through the Planning Commissions. <br /> PLANNING DIRECTOR'S RECOMMENDATION <br /> The County Council has always had the authority to add or remove conditions of <br /> rezones that are recommended by the Planning Director and Planning Commissions.
