Roth, via Communication No. 50 dated
December 20, 2022, amends Section 25-8-6 (Kailua-Honalo Urban Zone Map),Article 8, Chapter 25
(Zoning Code) of the Hawaii County Code 1983 (2016 Edition, as Amended), by changing the district
classification from Agricultural-Five Acres (A-5a) to Family Agricultural-One Acre (FA-1 a) at Keauhou,
North Kona, Hawaii, covered by Tax Map Key: 7-7-008:062. The applicant is Shawn Maile Nakoa, Esq.,
and the subject parcel covers 5.292 acres.
The Leeward Planning Commission forwards its favorable recommendation for this change of zone request,
which would allow the applicant to subdivide the property into three lots of at least one acre. The property is
located approximately a quarter mile northwest of its intersection with Kamehameha III Road, Pahoehoe 1St_
Kapalaalaea 2nd in North Kona.
Present in the Kona Council Chambers were Planning Program Manager Jeff Darrow; Applicant,
Shawn Maile Nakoa, Esq.; John Pippen, representing Land Planning Hawaii, LLC; and property owners,
Jeannie Clement and Thomas Clement,
Ms.Nakoa explained that the Third Circuit Judge appointed her as the partition petitioner in
Civil No. CCV 2000 325. In this capacity, Ms. Nakoa explained that she is the applicant and is authorized
to subdivide the property into three lots, for which this request for a change of zone is required.
Council Members made several inquiries about requirements for roads, water, and sewer requirements, and
extensive discussion was had regarding the sewer requirement being such a huge expense. Mr. Darrow
explained that pursuant to the County Code they are required to hook up to the County sewer system because
it is within 300 feet of it.
Your Committee on Legislative Approvals and Acquisitions is in accord with the purpose and intent of
Bill No. 12, and recommends its passage on first reading.
w b
AYES NOEs ABs Ex Respectfully submitted,
EVANS X
GALIMBA X COMMITTEE ON LEGISLATIVE
INABA x APPROVALS AND ACQUISIT NS
KAGIWADA X
KANEALI°I-KLEINFELDER X
KIERKIEwICz x OLEKA GORO INABA, CHAIR
KIMBALL X
LEE LOY X LAAC REPORT NO.: 9 _
VILLEGAS X ADOPTED: EEB 0
