<br /> SITUATE AT OPIHIKAO, DISTRICT OF PUNA, COUNTY AND STATE OF HAWAII,
<br /> FROM JAMES L. KERVER AND MELANY L. KERVER, TRUSTEES UNDER THE
<br /> UNRECORDED "JAMES L. AND MELANY L. KERVER REVOCABLE TRUST"

<br /> WHEREAS, James L. Kerver and Melany L. Kerver, Trustees under the unrecorded
<br /> "James L. and Melany L. Kerver Revocable Trust"dated February 21, 2013 ("Kervers") are the
<br /> owners of Lots C, D, E, F and G of the subdivision of Parcel 2 of Royal Patent Grant Number
<br /> 1895 to Mohala, being Tax Map Keys: (3) 1-3-004:023, :024, :025, :026 and :027, situated at
<br /> `Opihikao, District of Puna, County and State of Hawaii, as delineated on Exhibit"A" attached;
<br /> and
<br /> WHEREAS, the Kervers are desirous of donating the subject parcel to the County of
<br /> Hawaii for the purpose of unencumbered open space; and
<br /> WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter,provides that
<br /> the Council may accepts gifts, which include the donation of real property, on behalf of the
<br /> County of Hawaii; now, therefore,
<br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that in
<br /> accordance with Article XIII, Section 13-12 of the Hawaii County Charter,the County of
<br /> Hawaii accepts the donation of Lots C, D, E, F and G of the subdivision of Parcel 2 of Royal
<br /> Patent Grant Number 1895 to Mohala, being Tax Map Keys: (3) 1-3-004:023, :024, :025, :026
<br /> and :027, situate at `Opihikao, District of Puna, County and State of Hawaii, as delineated on
<br /> Exhibit "A" attached, for the purpose of unencumbered open space.
<br /> BE IT FURTHER RESOLVED that a letter of appreciation be sent to the Kervers
<br /> acknowledging their generous donation.
