COUNTY OF HAWAIII STATE OF HAWAM <br /> E CF N►' <br /> RESOLUTION NO. 182 23 <br /> A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A <br /> INTERGOVERNMENTAL AGREEMENT WITH THE DEPARTMENT OF <br /> THE ARMY REGARDING THE WALSKEA-PALAI FLOOD RISK <br /> MANAGEMENT PROJECT. <br /> WHEREAS, Hawaii Revised Statutes Section 46-7 requires the County to obtain <br /> consent of the Council to enter into agreements with the federal or state governments respecting <br /> action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive <br /> any funds or other assistance in connection with projects being or to be undertaken pursuant to <br /> those powers; and <br /> WHEREAS,the County of Hawaii Charter, Section 10-11, requires that any contract or <br /> other obligation requiring the payment of funds from the appropriations of a later fiscal year or <br /> of more than one fiscal year shall be approved by resolution; and <br /> WHEREAS,the Department of Public works desires to enter into a Project Partnership <br /> Agreement with the Department of the Army for the Waiakea-Falai Flood Risk Management <br /> Project, which provides the parameters for the design, construction, and maintenance of the <br /> Kupulau Ditch Detention and the Hilo Municipal Golf Detention ("Project"); and <br /> WHEREAS,pursuant to the authority provided in Section 205 of the Flood Control Act <br /> of 1948 (33 U.S.C. 701s) ("Section 205"), the design and construction of the Project was <br /> approved by the Department of the Army by the Division Commander for Pacific Ocean <br /> Division on September 29, 2022; and <br /> WHEREAS, Section 103 of the Water Resources Development Act(WRDA) of 1986, as <br /> amended (33 U.S.C. 2213), specifies the cost-sharing requirements applicable to the Project; and <br /> WHEREAS,total Federal costs associated with planning, design, and construction of a <br /> project pursuant to Section 205 may not exceed $10,000,000 and the County's costs may not <br /> exceed 50% of the construction costs; now,therefore, <br />
