AN ORDINANCE AMENDING CHAPTER 2,ARTICLE 47, OF THE AWAI`I COUNTY CODE 1983 (2016 EDITION,AS AMENDED), RELATING TO THE APPROPRIATION OF DISASTER RELIEF FUNDS FOR DAMAGES, LOSSES,AND SUFFERING CAUSED BY THE 2018 KILAUEA ERUPTION. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Chapter 2, article 47, of the Hawaii County Code 1983 (2016 Edition, as amended), is amended as follows: "Article 47. Disaster Relief[mtd]s Recovery[:], and Resilience. Section 2-246. Findings and purpose. The purpose of this article is to establish standards for the appropriation of disaster relief funds that the County received, or may receive, for the purposes of providing relief, recovery, mitigation, and [feme iat f ] long-term resilience for disaster [df ge,] damages, losses, and suffering caused by the 2018 Kilauea eruption. The [Cour] council finds that the appropriation of the disaster relief funds in accordance with this article constitutes a valid public purpose. Section 2-247. Definitions. As used in this article, unless otherwise specified: "Director" means the director of finance of the County. "Disaster relief' means monies awarded in the form of a grant to an eligible nonprofit organization for the purposes of relief, recovery, mitigation, or [remediatio ] lon -tg erm resilience following the 2018 Kilauea eruption. "Disaster relief funds"means funds from other public entities or private donors appropriated to the County for the purposes of relief, recovery, mitigation, or [re��] long-term resilience following the 2018 Kilauea eruption. "Long-term resilience"means the cqpacily to adapt to changing conditions and to prepare for, withstand, and rapidly recover from disruptions to everyay life. "Nonprofit organization" means an organization organized for other than profit-making purposes and which has a current 501(c)(3)tax-exemption from the Internal Revenue Code. Section 2-248. Applicability; restrictions of funding source; County reservation of funds. (a) This article shall apply exclusively to the appropriation of disaster relief funds for the purpose of providing disaster relief and long-term resilience to eligible nonprofit organizations. This article shall not apply to any other County funds not appropriated for disaster relief purposes.
