i <br /> i <br /> V OF N� <br /> COUNT' OF HAWAII STATE OF HAWAII <br /> 1,rF OF°hd P� <br /> I <br /> it <br /> SOLUTION NO. 209 <br /> (DRAFT 2) <br /> A RESOLUTION TO AWARD A PUBLIC ACCESS, OPEN SPACE, AND NATURAL <br /> SOURCES PRESERVATION MAINTENANCE FUND STEWARDSHIP GRANT TO <br /> HO`OALU KA`U. <br /> WHEREAS, Section 10-16 of the Hawaii County Charter establishes a Public Access, <br /> Open Space, and Natural Resources Preservation Maintenance Fund(hereinafter "Maintenance <br /> Fund") "to preserve the land,promote public safety, and maintain a healthy stewardship"; and <br /> WHEREAS, Section 10-16(h) of the Hawaii County Charter provides that the <br /> Maintenance Fund may be used for a stewardship grant program for properties purchased via the <br /> Public Access, Open Space, and Natural Resources Preservation Fund, which allows 501(c)3 <br /> nonprofit organizations to apply for grant-in-aid project funding for stewardship projects; and <br /> WHEREAS, Ho`omalu Ka`u is a 501(c)3 nonprofit organization with a stated mission of <br /> its project committee, Kahua `Olohu, "to support and guide a community-managed wahi pana of <br /> Ka`n based on the cultural, spiritual and educational practices, and protocols of our ancestors"; <br /> and <br /> WHEREAS, Ho`omalu Ka`u submitted a Maintenance Fund stewardship grant <br /> application to continue providing land stewardship and cultural education for the Kahua `Olohu, <br /> Ka`u property, which is situated in in the District of Ka`u (TMK: (3) 9-5-012:005), and acquired <br /> via the Public Access, Open Space, and Natural Resources Preservation Fund after adoption of <br /> Resolution No. 287-15; and <br /> WHEREAS, during its September 12, 2022, meeting and pursuant to Section 2-217 of <br /> the Hawaii County Code 1983 (2016 Edition, as amended), the Public Access, Open Space, and <br /> Natural Resources Preservation Commission forwarded a positive recommendation for this <br /> project to the Director of Finance; and <br /> WHEREAS, Communication No. 336, issued by the Director of Finance on June 13, <br /> 2023, submitted for the Council's consideration six applicants for stewardship grants for the <br /> grant year 2023, beginning July 1, 2023, through June 30,2024, for various properties that have <br /> been acquired by the County using the Public Access, Open Space, and Natural Resources <br /> Preservation Fund; and <br /> WHEREAS, the Director of Finance in Communication No. 336 recommends that <br /> Ho`omalu Ka`u will be able to complete its project in accordance with the project description <br /> submitted and in strict adherence to the conditions governing the Public Access, Open Space, <br /> and Natural Resources Preservation Maintenance Fund; and <br />
