<br /> A RESOLUTION TO AWARD A PUBLIC ACCESS, OPEN SPACE,AND NATURAL
<br /> RESOURCES PRESERVATION MAINTENANCE FUND STEWARDSHIP GRANT TO
<br /> MALAMA 0 PUNA.
<br /> WHEREAS, Section 10-15 of the Hawai`i County Charter provides for a Public Access,
<br /> Open Space, and Natural Resources Preservation Fund to acquire lands and easements in the County
<br /> of Hawai`i for public outdoor recreation, education, and preservation of coastal areas; and
<br /> WHEREAS, Section 10-16 of the Hawai`i County Charter provides for a Public Access,
<br /> Open Space, and Natural Resources Preservation Maintenance Fund (hereinafter"Maintenance
<br /> Fund")to preserve these lands, promote public safety, and maintain healthy land stewardship; and
<br /> WHEREAS, Section 10-16(h) of the Hawai`i County Charter provides that the Maintenance
<br /> Fund may be used for a stewardship grant program for properties purchased via the Public Access,
<br /> Open Space, and Natural Resources Preservation Fund, which allows 501(c)3 nonprofit organizations
<br /> to apply for grant-in-aid funding for stewardship projects; and
<br /> WHEREAS, Malama 0 Puna is a 501(c)3 nonprofit organization dedicated to protecting
<br /> Hawai`i's precious natural heritage through partnerships, education, training, consultation, advocacy,
<br /> and hands-on work in the `aina; and
<br /> WHEREAS, Malama 0 Puna has submitted a Maintenance Fund stewardship grant
<br /> application to continue providing land stewardship and cultural education for the Wai`ele, Puna
<br /> property, identified as tax map keys (3) 1-4-003:003 and 037, and acquired via the Public Access,
<br /> Open Space, and Natural Resources Preservation Fund after adoption of Resolution No. 170-21; and
<br /> WHEREAS, during its September 12, 2022, meeting, and pursuant to Section 2-217 of
<br /> the Hawaii County Code 1983 (2016 Edition, as amended),the Public Access, Open Space, and
<br /> Natural Resources Preservation Commission forwarded a positive recommendation for this project to
<br /> the Director of Finance; and
<br /> WHEREAS, Communication No. 336, issued by the Director of Finance on June 13, 2023,
<br /> submitted for the Council's consideration six applicants for stewardship grants for the period of July
<br /> 1, 2023,through June 30, 2024, for various properties that have been acquired by the County using
<br /> the Public Access, Open Space, and Natural Resources Preservation Fund; and
<br /> WHEREAS, in Communication No. 336,the Director of Finance's recommendation is that
<br /> Malama 0 Puna will be able to complete its project in accordance with the project description
<br /> submitted, and in strict adherence to the conditions governing the Maintenance Fund; and
