No. 680/Res.No. 406-24 PLACE: Council Chambers Kailua-Kona, Hawai`i TIME: 10:40 a.m. Council Chair and Members Hawai`i County Council Hilo, Hawai`i 96720 Your Committee on Legislative Approvals and Acquisitions, to which was referred Resolution No. 406-24, reports as follows: Resolution No. 406-24, transmitted by Sinclair Salas-Ferguson, via Communication No. 680, dated December 5, 2023, accepts the dedication of roadway parcel identified as all of that certain parcel of land(being a portion of land described in and covered by Royal Patent Grant Number 6586, Land Commission Award Number 8689-B to Heleanaole) situated, lying and being at Kapa'au District, of North Kohala, Island and County of Hawai`i, State of Hawai`i, and designated as Tax Map Key: 5-4-004-015 ("access road") from Kapa'au Water Works Community Association, a Hawai`i nonprofit corporation. The landowner seeks to dedicate the roadway and all improvements for public roadway purposes. Deputy Corporation Counsel Sinclair Salas-Ferguson and Public Works Director Steve Pause explained that this is a road lot that the County has been controlling or maintaining, and that this process would allow the current owner to transfer the roadway to the County. Pursuant to Section 13-12 of the Hawai`i County Charter, the Council, on behalf of the County, may accept gifts, including real estate or any interest in real estate.
