28. On February 21, 1995, the Office of Planning <br />("OP") (formerly known as Office of State Planning), filed its <br />Motion to Declare Petition Defective. <br />29. On February 23, 1995, the Commission conducted a <br />continued action meeting on the various requests for <br />intervention. Due to the filing of the OP's Motion to Declare <br />Petition Defective on February 21, 1995, the Commission continued <br />action on the requests for intervention. <br />30. On March 23, 1995,the commission conducted a <br />continued action meeting on the various requests for <br />intervention. Action was deferred by the Commission due to the <br />filing of a Stipulation to Continue Motions on Office of State <br />Planning's Motion to Declare Petition Defective; Petitions for <br />Intervention; Petitioner's Motion to Waive Requirement for <br />Landowner's Written Authorization; and Petitioner's Motion to <br />Amend Petition, filed by Petitioner and OP. <br />31. On May 15, 1995, Petitioner filed its Amended <br />Motion for Permission to Amend Petition by Further Reducing the <br />Total Acreage of the Petition Area ("Fifth Amended Petition"). <br />The Fifth Amended Petition reduced the Petition Area from <br />approximately 3,728 acres to approximately 970.80 acres by <br />deleting the northern portion of the initial Petition Area from <br />Kailua-Kona to Keahole from the Petition. <br />C2. On May 25, 1995,the Commission conducted <br />meeting to continue action on OP's Motion to Declare Petition <br />Defective, and to take action on Petitioner's Fifth Amended <br />Petition.
