No. 874/Res.No. 517-24
PLACE: Council Chambers
Hilo, Hawai`i
TIME: 10:47 a.m.
Council Chair and Members
Hawai`i County Council
Hilo, Hawai`i 96720
Your Committee on Legislative Approvals and Acquisitions, to which was referred Resolution
No. 517-24, reports as follows:
Resolution No. 517-24, transmitted by Finance Director Diane Nakagawa, via Communication
No. 874, dated April 26, 2024, authorizes the acquisition of private property by eminent domain of
Tax Map Key: 8-6-008:011, situated at Waiea, District of South Kona, County and State of Hawai`i,
for continued use of the Waiea Convenience Center by the Solid Waste Division of the Department of
Environmental Management
The County seeks to acquire approximately 2.282 acres of land to continue to operate the Waiea
Convenience Center, also known as the Waiea Recycling and Transfer Station.
Deputy Corporation Counsel Diana Mellon-Lacey and Deputy Director of Environmental Management,
Brenda Iokepa-Moses was available for questions. The purpose of this resolution is to allow the
County to purchase this transfer station property which has been operating from this location for over
thirty years. Ms. Mellon-Lacey explained that there is a defect in title and an owner was not
comfortable going forward with a quitclaim deed, and the County would not consider it. She further
stated that a decision was made to seek condemnation to address the title issue so the County could
obtain clear title.
This resolution was amended with the contents of Communication No. 874.1, which was submitted by
the Department of Environmental Management.
Your Committee on Legislative Approvals and Acquisitions is in accord with the purpose and intent of
Resolution No. 517-24, as amended to Draft 2, and recommends its adoption.
wpb
AYES NOES ABS EX Respectfully submitted,
EVANS X
GALIMBA x COMMITTEE ON LEGISLATIVE
INABA x APPROVALS AND ACQUISITIONS
KAGIWADA X
KANEALI`I-KLEINFELDER X
KIERKIEWICZ X OLEKA GORO INABA, CHAIR
KIMBALL X
LEE LOY X LAAC REPORT NO.: 58
VILLEGAS X ADOPTED: JUN 0 5 2024
