issuance of Plan Approval and the affordable housing agreement shall be <br /> implemented prior to occupancy of any unit in each phase. <br /> Y. The Applicant shall comply with all applicable County, State, and Federal codes, laws, <br /> rules,regulations, and requirements for the proposed development. <br /> Z. An annual progress report shall be submitted to the Planning Director prior to the <br /> anniversary date of the enactment of this amended ordinance. The report shall include, <br /> but not be limited to,the status of the development and the extent to which the conditions <br /> of approval are being satisfied. This condition shall remain in effect until all of the <br /> conditions of approval have been satisfied and the Director, acknowledges that further <br /> reports are not required. <br /> AA. If the Applicant should require an additional extension of time,the Planning Director <br /> shall submit the Applicant's request to the County Council for appropriate action. <br /> BB. Should any of the conditions not be met or substantially complied with in a timely <br /> fashion,the Planning Director may initiate rezoning of the area to its original or more <br /> appropriate designation." <br /> SECTION 2. Material to be deleted is bracketed and stricken. New material is <br /> underscored. <br /> SECTION 3. Severability. If any provision of this ordinance, or the application thereof <br /> to any person or circumstance, is held invalid,the invalidity does not affect other provisions or <br /> applications of the ordinance which can be given effect without the invalid provision or <br /> application, and to this end the provisions of this ordinance are severable. <br /> -13- <br />
