ja• <br /> i,,;, <br /> COUNTY OF HAWAI`I '+ �_ : _ !.> STATE OF HAWAI`I <br /> • o._ J <br /> RESOLUTION NO. 549 24 <br /> RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN <br /> AGREEMENT WITH THE DEPARTMENT OF THE ARMY <br /> PURSUANT TO HRS 46-7, REGARDING AN AQUATIC <br /> ECOSYSTEM RESTORATION STUDY OF KAHALU`U BAY <br /> WHEREAS, the Department of Parks and Recreation desires to enter into a <br /> fifty percent cost sharing agreement with the Department of the Army for an <br /> aquatic ecosystem restoration study of Kahalu`u Bay; and <br /> WHEREAS, Section 206 of the Water Resources Development Act of 1996 <br /> authorizes the United States Army Corps of Engineers to initiate investigations and <br /> implement projects for aquatic ecosystem restoration with the objective of <br /> restoring degraded ecosystem structure, function and dynamic process to a less <br /> degraded, more natural condition with consideration of the ecosystem's natural <br /> integrity, productivity, stability, and biological diversity; and <br /> WHEREAS, Section 105(a) of the Water Resources Development Act of <br /> 1986 specifies the cost-sharing requirements applicable to this study; and <br /> WHEREAS, Hawaii Revised Statutes, Section 46-7, requires that County <br /> departments obtain the consent of the council to enter into agreements with the <br /> federal or state governments respecting action to be taken pursuant to any of the <br /> powers granted by law to furnish, expend, and receive any funds or other <br /> assistance in connection with projects being or to be undertaken pursuant to those <br /> powers; now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in <br /> accordance with section 46-7, Hawaii Revised Statutes, that the Mayor of the <br />
