Kimball, Council Chair <br /> Council District 1 <br /> SUBJECT: Proposed Amendments to Bill No. 121; An Ordinance Amending Chapter <br /> 25, Articles 1, 4, and 5, of the Hawaii County Code 1983 (2016 Edition, <br /> as Amended), Relating to Transient Accommodation Rentals and Hosting <br /> Platforms. <br /> Transmitted herewith are proposed amendments to Bill No. 121. The proposed amendments are <br /> shown below in Ramseyer format with respect to the contents of Bill No. 121, material to be <br /> deleted is bracketed and stricken, and material to be inserted is underscored. <br /> SECTION 2 of Bill No. 121, which amends chapter 25, article 1, section 25-1-5, of the Hawai`i <br /> County Code 1983 (2016 Edition, as amended)by adding definitions, is amended by amending <br /> the new definitions of"transient" and"transient accommodation"to read as follows: <br /> "Transient" or"transients"means any visitor or person who rents or uses a lodging or <br /> dwelling unit, or portion thereof, for [less tha„ ne hundred eight y s] thirty consecutive days <br /> or less and whose permanent address for legal purposes is not the [lodging or dwelling unit <br /> occupied by the visitor.] transient accommodation rental. This definition shall not apply to: <br /> (1) Nonpaying guests of the family occupying the unit; <br /> (2) Clients in health care facilities; <br /> (3) Full-time students enrolled in an educational institution in the County of Hawai`i; <br /> (4) Employees who receive room and/or board as part of their salary or compensation <br /> including agricultural workers; <br /> (5) Occupants of group living facilities, authorized by the department of health; <br /> (6) Military personnel; <br /> (7) Health care workers temporarily employed at a medical facility in the County of <br /> Hawai`i; <br /> Comm.
