Y. The Applicant shall comply with all applicable County, State, and Federal codes, laws, <br />rules regulations, and requirements for the ro osed develo incnt. <br />Z. An annual nroaress report shall be submitted to the Planniniz Director mior to the <br />anniversar date of the enactment of this amended ordinance. The re ort shall include <br />but not be limited to, the status of the development and the extent to which the conditions <br />of approval are being satisfied. This condition shall remain in effect until all of the <br />conditions of approval have been satisfied and the Director, acknowledges that further <br />reports are not required. <br />AA. If the applicant fails to fulfill any conditions of this change of zone within the specified <br />time limitations the Planning Director or Coun1y Council inay initiate the process for <br />enactment of an ordinance reverting the affected property back to its original zoning <br />desi nation or a more appropriate zoning desi nation in accordance with Section 25-2-43 <br />of the Hawaii County Code. <br />BB. An initial extension of time for the erformance of conditions within this ordinance may <br />be requested in accordance with Section 25-2-44, subsection (c) and (d), of the Hawaii <br />Count" <br />SECTION 2. Material to be deleted is bracketed and stricken. New material is <br />underscored. <br />SECTION 3. Severability. If any provision of this ordinance, or the application thereof <br />to any person or circumstance, is held invalid, the invalidity does not affect other provisions or <br />applications of the ordinance which can be given effect without the invalid provision or <br />application, and to this end the provisions of this ordinance are severable. <br />-14- <br />
