COUNTY OF HAWAI`I •(. �.' w STATE OF HAWAI`I BILL NO. 179 (DRAFT 2) ORDINANCE NO. AN ORDINANCE AMENDING CHAPTER 16, ARTICLE 3, SECTION 16-5, OF THE HAWAI`I COUNTY CODE 1983 (2016 EDITION, AS AMENDED), RELATING TO COMMUNITY DEVELOPMENT PLAN ACTION COMMITTEES. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI`I: SECTION 1. Chapter 16, article 3, section 16-5, of the Hawai`i County Code 1983 (2016 Edition, as amended), is amended by amending subsection (a) to read as follows: "(a) The CDP action committee shall consist of nine members. All members shall have a [pr-imaiT] principal residence in the area covered by the CDP. The determination of "principal residence" shall be in accordance with criteria described in chapter 19, section 19-71(e) of this Code, however,there is no requirement that a member own property. The members shall be appointed by the mayor and approved by the County council. Prior service as a member of a CDP steering committee shall not disqualify an individual from serving on the CDP action committee." SECTION 2. Material to be repealed is bracketed and stricken.New material is underscored. In printing this ordinance,the brackets, bracketed and stricken material, and underscoring need not be included. SECTION 3. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of the ordinance that can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are severable. SECTION 4. This ordinance shall take effect upon its approval.
