Sako <br />Managing Director <br />County of Hawaii <br />LEEWARD PLANNING COMMISSION <br />Aupuni Center - 101 Paualri Street, Suite 3 # Hilo, Hawaii 96720 <br />Phone (808) 961-8288 - Fax (808) 961-8742 <br />July 26, 2024 <br />Heather Kimball, Council Chair <br />and Members of the County Council <br />County of Hawaii <br />25 Aupuni Street <br />Hilo, HI 96720 <br />Dear Chair Kimball and Council Members: <br />Barbara DeFranco, Chair <br />Mahina Paishon-Duarte, Vice Chair <br />Dean Au <br />Michael Dela Cruz <br />Clement "CY Kanuha III <br />Donna Kinuko Noborikawa <br />Armando Rodriquez <br />SUBJECT: County Council Initiated Bill No. 134 (PL-CCI-2024-000007) <br />Draft 2, Amendment to Chapter 25 Article 2, Section 25-2-42 of the Hawaii <br />County Code 1983 (2016 Edition, As Amended) Relating to Amendments <br />Initiated by Property Owners and Other Persons <br />The Leeward Planning Commission (Commission), at its duly held public hearing on July 18, <br />2024, considered the County Council Initiated Bill No. 134, Draft 2, amending Chapter 25, <br />Article 2, Section 25-2-42, of the Hawaii County Code 1983 (2016 Edition, as amended) <br />relating to amendments initiated by property owners and other persons. <br />The Commission heard Bill No. 134, Draft 2 at their public hearing on June 20, 2024, and voted <br />to defer action on the bill to allow the Planning Director and Councilmembers Inaba and Evans <br />to continue discussions in order to reach consensus about how to amend Bill No. 134, Draft 2. In <br />an email dated July 17, 2024, Councilmember Inaba provided suggested amended language for <br />Bill No. 134, Draft 2 to the Commission. <br />The Commission voted to forward a favorable recommendation of Bill No. 134, Draft 2 to the <br />County Council incorporating Councilmember Inaba's suggested amendment and further <br />amended the language related to including properties in the report within a one -quarter mile <br />radius of the property being rezoned. The Commission recommends Bill No. 134 be amended as <br />follows: <br />The director shall prepare a report identifying properties within a distance consistent with <br />Hawaii County Code, Section 25-2-4 (Notice to Property Owners and Lessees of Record of <br />Pending Application) of the subject property that have undergone a change of zone, any <br />ordinance(s) relevant to the change of zone, and the status of those change of zone ordinance(s). <br />The report shall also identify properties within the same distance that can be subdivided under <br />Hawaii County is an Equal Opportunity Provider and Employer <br />
