Kimball, Council Chair <br />and Members of the Hawaii County Council <br />FROM: Jennifer Kagiwada, Council Member 46- <br />SUBJECT: Proposed Amendments to Bill No. 104, Draft 6; an Ordinance Amending Chapter <br />19, Article 1, Section 19-2; Chapter 19, Article 7, Section 19-53; and Chapter 19, <br />Article 11, Section 19-90, of the Hawaii County Code 1983 (2016 Edition, as <br />Amended), Relating to the Creation of a Long -Term Rental Class for Real <br />Property Taxes. <br />Transmitted herewith are proposed amendments to Bill No. 104, Draft 6. The amendments are <br />shown below in Ramseyer format with respect to the contents of Bill No. 104, Draft 6; material <br />to be deleted is bracketed and stricken, and material to be added is underscored. A copy of the <br />new draft of this bill that would result if these proposed amendments were adopted is <br />intentionally omitted due to the limited scope of the amendments. <br />SECTION 2 of Bill No. 104, Draft 6, which amends chapter 19, article 1, section 19-2, of the <br />Hawaii County Code 1983 (2016 Edition, as amended) by adding a definition, is amended to <br />read as follows: <br />""Long-term rental" means property occupied [for- twelve eonseeutive fnenths and] under a <br />signed lease for six consecutive months or more to the same tenant(s)." <br />2. SECTION 4 of Bill No. 104, Draft 6, which amends chapter 19, article 7, section 19-53, of <br />the Hawaii County Code 1983 (2016 Edition, as amended) by adding three new subsections, <br />is amended by amending subsection (k) to read as follows: <br />"(k) Eligibility for long-term rental class. <br />(1) Real property occupied [fef twelve eenseetAive menths and] under a signed lease for <br />six consecutive months or more to the same tenant(s) shall be eligible. <br />(2) [A41] Except for the owner's principal residence, all dwelling units on long-term <br />rental properties must be leased. <br />COM171. <br />Ref.
