Page 20 <br />1 spiritual means in accordance with the tenets and practice of any well recognized church <br />2 or religious denomination, provided that no person claims to practice as a certified <br />3 midwife, certified professional midwife or a licensed midwife; <br />4 (9) A person acting as a traditional birth attendant who: <br />5 (A) Does not use legend drugs or devices, the use of which requires a license <br />6 under the laws of the State⢠<br />7 (B) Does not advertise that the person is a licensed midwife; <br />8 (C) Discloses to each client verbally and in writing at the time care is first <br />9 initiated: <br />10 (i) That the person does not possess a professional license issued by the <br />11 State to provide health or maternity care to women or infants; <br />12 (ii) That the person's education and qualifications have not been <br />13 reviewed by the State; <br />14 (iii) The person's education and training, <br />15 (iv) That the person is not authorized to acquire, carry, administer, or <br />16 direct others to administer legend drugs; <br />17 (v) Any judgment, award, disciplinary sanction, order, or other <br />18 determination that adjudges or finds that the person has committed <br />19 misconduct or is criminally or civilly liable for conduct relating to <br />20 midwifery y a licensing or regulatory authority, territory, state, or any <br />21 other jurisdiction; and <br />22 (vi) A plan for transporting the client to the nearest hospital if a problem <br />23 arises during the client's care; and <br />mi <br />
