JM�V Us M,�7 <br />COUNTY OF HAWAPI -•` _* STATE OF HAWAN <br />1tE Of•M►� <br />RESOLUTION NO. 6G3 24 <br />A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A NINE-YEAR <br />INTERGOVERNMENTAL AGREEMENT WITH THE UNIVERSITY OF HAWAI`I FOR <br />A RADIO REPEATER SITE. <br />WHEREAS, Hawaii Revised Statutes Section 46-7 requires that County departments <br />obtain the consent of the Council to enter into agreements with the federal or state governments <br />respecting action to be taken pursuant to any of the powers granted by law to furnish, expend, <br />and receive any funds or other assistance in connection with projects being or to be undertaken <br />pursuant to those powers; and <br />WHEREAS, the Hawaii County Charter Section 10-11 requires that any contract, lease <br />or other obligation requiring payment of funds from the appropriations of a later fiscal year or of <br />more than one fiscal year be approved by resolution; and <br />WHEREAS, the Hawaii County Civil Defense Agency wishes to enter into a Non - <br />Exclusive License Agreement with the University of Hawaii, a public body corporate and the <br />public Licensor of the State of Hawaii to continue to maintain and utilize a recently installed <br />amateur radio repeater on the summit of Mauna Kea for the purpose of an island -wide <br />community emergency radio communications network to facilitate the Hawaii County Auxiliary <br />Communications Service; and <br />WHEREAS, this nine (9) year License Agreement will support the Hawaii County Civil <br />Defense Agency's continued desire to supplement its connectivity for the Island of Hawaii by <br />extending its initially approved one (1) year License Agreement which allowed the installation of <br />a radio repeater within a portion of the astronomy facility known as the University of Hawaii <br />2.2-meter Telescope Utility Building, by allowing the Parties to execute an approximately nine <br />(9) year License Agreement that would expire on December 31, 2033 (unless otherwise <br />terminated sooner); now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`I that in <br />accordance with Hawaii Revised Statutes Section 46-7, and the Hawaii County Charter Section <br />10-11, that the Mayor of the County of Hawaii is authorized to execute, on behalf of the County, <br />
