No. 1093/Bill No. 217 <br />PLACE: Council Chambers <br /> Hilo, Hawai‘i <br />TIME: 11:05 a.m. <br /> <br />Council Chair and Members <br />Hawai‘i County Council <br />Hilo, Hawai‘i 96720 <br /> <br />Your Policy Committee on Planning, Land Use, and Development, to which was referred Bill <br />No. 217, reports as follows: <br /> <br />Bill No. 217, transmitted by Council Member Cindy Evans via Communication No. 1093, dated <br />September 24, 2024, amends Chapter 6, Article 2, Section 6-12, of the Hawaiʻi County Code <br />1983 (2016 Edition, as amended), relating to prohibited highways for commercial bicycle tours. <br /> <br />The bill seeks to add a portion of Kohala Mountain Road and a portion of Akoni Pule Highway <br />as prohibited highways for commercial bicycle tours. <br /> <br />As Bill 217 was introduced, Committee Vice Chair Holeka Inaba assumed the role of Acting <br />Chair, with Committee Chair Ashley Kierkiewicz absent. <br /> <br />Public Works Director Steven Pause and Corporation Counsel Elizabeth Strance were available <br />in the Kona Chambers for questions. <br /> <br />Ms. Evans explained the bill would prohibit commercial bicycle tours on two roads in Kohala <br />due to community safety concerns. <br /> <br />County Clerk Jon Henricks noted the review process pursuant to Chapter 6, Article 2, Section 6- <br />11(b), about soliciting feedback from State and County agencies. <br /> <br />Committee Members Matt Kānealiʻi-Kleinfelder, Susan Lee Loy, and Heather Kimball agreed to <br />proceed with the review process. Ms. Kimball suggested holding the measure in Committee until <br />hearing from governmental agencies. Ms. Lee Loy and Committee Member Jennifer Kagiwada <br />recommended sending the measure to the Hawai‘i Department of Transportation (HDOT). <br />Mr. Pause confirmed Kohala Mountain Road is state-controlled, while Akoni Pule Highway is <br />under County jurisdiction. Ms. Strance shared she would need to verify if a County ordinance <br />can regulate a state highway. <br /> <br />Ms. Evans motioned to forward the bill to the Police Chief, Public Works Director, and Director <br />of HDOT.
