NO. <br />I expressly excluded by law from membership in the system; <br />2 provided that: <br />3 (A) The retirant was not employed by the State <br />4 or a county during the six calendar months prior to the first <br />5 day of reemployment; and <br />6 (B) No agreement was entered into between the <br />7 State or a county and the retirant, prior to the retirement of <br />8 the retirant, for the return to work by the retirant after <br />9 retirement; <br />10 (4) In a position identified by the appropriate <br />11 jurisdiction as a labor shortage or difficult -to -fill position; <br />12 provided that: <br />13 (A) The retirant was not employed by the State <br />14 or a county during the twelve calendar months prior to the first <br />15 day of reemployment; <br />16 (B) No agreement was entered into between the <br />17 State or a county and the retirant, prior to the retirement of <br />18 the retirant, for the return to work by the retirant after <br />19 retirement; and <br />20 (C) Each employer shall contribute to the <br />21 pension accumulation fund the required percentage of the rehired <br />
