Daryn Arai <br />Lund Use Planning Cons«ItarIt <br />November 7, 2024 <br />Mrs. Heather Kimball, Chairperson <br />And members of the Hawaii County Council <br />25 Aupuni Street <br />Hilo, HI 96720 <br />Dear Chair Kimball and Members of the Hawaii County Council: <br />_0 <br />SUBJECT: Request to Postpone November 20, 2024 Hearing on Bill No. 169, Draft 3 <br />regarding proposed Amendments to Change of Zone Ordinance No. 02-131 <br />Tax Map Key: (3) 7-6-021:016 & 017, H61ualoa, North Kona, Hawaii <br />On behalf of Kona Three LLC, the Applicant and landowner affected by the above - <br />referenced bill, we would like to request a postponement of an anticipated hearing on the bill <br />tentatively scheduled for November 20, 2024 as requested by Councilme nber Rebecca Villegas <br />in her memo dated October 24, 2024 and referenced as Communication No. 896,214, <br />Kona Three LLC requests the courtesy of a postponement as it wishes to focus on its <br />efforts to negotiate with the Director of Finance regarding the possible acquisition of the subject <br />properties by the County utilizing Public Access, Open Space, and Natural Resources <br />Preservation Fund, as directed by the Council's Resolution No. S61 24. The Applicant is <br />pursuing negotiations with the County in good faith, and wishes to not be distracted in its <br />ongoing efforts by any concurrent proceedings. <br />We hope that the Council finds this request sincere and reasonable.
