1 (1) Upgraded or converted to a director -approved <br />2 wastewater system; or <br />3 (2) Connected to a sewerage system <br />4 before January 1, 2035; <br />provided that priority level <br />1 <br />5 cess-000ls on recreational <br />residence leases within the <br />Kokee <br />6 state <br />park and Waimea Canyon <br />state park on <br />the island of Kauai <br />7 shall <br />be upgraded, converted, <br />or connected <br />before January 1, <br />8 2040. <br />9 (b) Every cesspool in the State designated as priority <br />10 level 2 according to the University of Hawaii's Hawaii cesspool <br />11 prioritization tool shall be: <br />12 (1) Upgraded or converted to a director -approved <br />13 wastewater system; or <br />14 (2) Connected to a sewerage system, <br />15 before January 1, 2040. <br />16 (c) The director may grant an exemption from the <br />17 requirements of subsections (a) and (b) to the property owner of <br />18 a cesspool who applies for an exemption and presents <br />19 <br />documentation <br />showing <br />a legitimate <br />reason <br />that <br />makes it <br />20 <br />infeasible to <br />uDarade, <br />convert, or <br />connect <br />the <br />cess-000l.
