STATE OF HAWAI`I <br /> BILL NO. 206 <br /> (DRAFT 2) <br /> ORDINANCE NO. 24 96 <br /> AN ORDINANCE REPEALING ORDINANCE NO. 84-39 AND AMENDING CHAPTER <br /> 14,ARTICLE 8, SECTION 14-44, OF THE HAWAII COUNTY CODE 1983 (2016 <br /> EDITION, AS AMENDED), RELATING TO NUCLEAR ENERGY. <br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br /> SECTION 1. Findings and Purpose. The County of Hawai`i recognizes the critical <br /> importance of safeguarding the health, safety, and welfare of its residents and environment. With <br /> growing concerns about the potential hazards posed by the transportation, storage, and <br /> development of nuclear materials, it is essential to ensure that all entities within the County, <br /> including military operations, are subject to appropriate regulatory measures. This ordinance <br /> seeks to remove the exclusion that previously applied to military activities in this regard, <br /> aligning with the County's broader commitment to minimizing radiation risks and maintaining a <br /> safe and clean environment for both present and future generations. This ordinance reflects the <br /> County's dedication to comprehensive public safety without compromising national security <br /> responsibilities. <br /> SECTION 2. Ordinance No. 84-39 is repealed. <br /> SECTION 3. Chapter 14, article 8, section 14-44 of the Hawai`i County Code 1983 <br /> (2016 edition, as amended) is amended to read as follows: <br /> "Section 14-44. Purpose. <br /> The purpose of this article is to maintain a clean and healthy environment for <br /> present and future generations in the County, to protect the health and safety of the <br /> residents of the County from radiation exposure resulting from dangers of accidents <br /> involving the transportation or storage of nuclear materials or the development of nuclear <br /> reactors, and to protect the general health, safety, comfort and welfare of the citizens of <br /> the County. <br /> [The purpose of article 8 shall not in any way inhibit or prohibit the military from <br /> carrying out their duties and responsibilities.]" <br /> • <br /> SECTION 4. Material to be repealed is bracketed and stricken. In printing this <br /> ordinance,the brackets and bracketed and stricken material need not be included. <br />
