Kimball, Chairperson <br />and Members of the Hawaii County Council <br />FROM: Dr. Holeka Goro Inaba, Council Member <br />Council District 8 <br />C <br />SUBJECT: Proposed Amendment to Bill No. 208; An Ordinance Amending Section 25-8- <br />11 (Lalamilo-Pu'ukapu Zone Map), Article 8, Chapter 25 (Zoning Code) of the <br />Hawaii County Code 1983 (2016 Edition, as Amended), by Changing the <br />District Classification from Agricultural — 40 Acres (A-40a) to Residential — <br />Agricultural — 0.5 Acres (RA-.5a) at Pu'ukapu, Waimea, South Kohala, <br />Hawaii, Covered by Tax Map Key: 6-4-017:001. <br />Transmitted herewith is a proposed amendment to Bill No. 208. The proposed amendment is <br />shown below in Ramseyer format with respect to the contents of Bill No. 208; material to be <br />added is underscored. A copy of the new draft of Bill No. 208 that would result if this proposed <br />amendment were adopted is not attached due to the limited scope of the amendment. <br />SECTION 2 of Bill No. 208 is amended by adding a condition to be appropriately inserted and to <br />read as follows: <br />"M. The deed of each i)ro-oosed lot shall contain a restrictive covenant Drohibitina the <br />construction of more than one (1) accessory dwelling unit thereon. A copy of the <br />proposed covenant(s) to be recorded with the State of Hawaii Bureau of <br />Conveyances shall be submitted to the Planning Director for review and approval <br />prior to the issuance of Final Subdivision Approval. A copy of the recorded <br />document shall be filed with the Planning Department upon its receipt from the <br />Bureau of Conveyances." <br />SECTION 2 of Bill No. 208 is further amended by redesignating Conditions M, N, 0, and P as <br />Conditions N, 0, P, and Q, respectively. <br />Thank you. <br />HGI:wpb No. 1 50.4 <br />Hawai'i County Is an Equal Opportunity Provider and Employer oyer R0.
